Payment, delivery and sales conditions of the Peggy Peg Shop UK (PPS for short)

Deliveries/delivery contracts for our products are carried out under the following conditions (even if they are not always referred to separately)! For all mutual claims from and in connection with the conclusion of a contract between the customer and the Peggy Peg Shop in the catalogue mail-order business, these General Terms and Conditions always apply in their form at the time the respective contract is concluded.

1. Prices/shipping

We only accept orders through order processing in the online shop. The selling price in GBP/EUR is the price on the day the order is accepted, which is always visible next to the article.
Our prices are in GBP/EUR from the UK warehouse (3PL TFH, Lockett Road, South Lancs Industrial Estate, Wigan, Greater Manchester, WN4 8DE) and include the current statutory value-added tax of 20 % (VAT United Kingdom) or 23% (VAT Ireland).
The standard shipping costs within the UK by DPD are £ 5.95. Otherwise, the shipping costs are calculated according to weight and country. (More on this under shipping conditions)
The invoice amount is to be transferred to us in full, any kind of bank charges (domestic and foreign) will be borne by the buyer! The recipient bears the risk of carriage, even if the delivery is carriage paid. All deliveries are made, without exception, by insured parcel up to max. £ 500.00  value of goods!
Cash on delivery items is not possible.

1.1 Reservation of availability:

Some items in our range are limited or special offers, we reserve the right to sell them out. Should PPS discover after the conclusion of the contract that the goods ordered are no longer available or cannot be delivered for legal reasons or unavailability at the manufacturer, PPS can either offer goods of equivalent quality and price or withdraw from the contract. Payments already received will be reimbursed immediately after withdrawal from the contract by PPS.

2. Right of withdrawal

You can submit your contract declaration within 2 weeks without giving reasons in writing (e.g. letter, fax, e-mail) or by returning the item. The period begins with receipt of this instruction at the earliest. The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline.

2.2 Consequences of cancellation

In the event of an effective revocation, the mutually received services are to be returned.
If you cannot return the received service in whole or in part or only in a deteriorated condition, you may have to compensate us for the value. This does not apply to the surrender of items if the deterioration of the item is solely due to its inspection - as it would have been possible for you in a shop. Incidentally, you can avoid the obligation to pay compensation by not using the item as an owner and by refraining from anything that may impair its value. Transportable items are to be sent back. In the event of a return from a delivery of goods with a total order value of up to £ 40, you have to bear the costs of the return, if the delivered goods correspond to the ordered ones. Otherwise, the return is free for you within Germany. You have to bear the costs of return as well if you are returning items from the United Kingdom.

3. Delivery time

We always endeavour to process the order as quickly as possible, shipping is via DPD. If desired, DHL can be chosen as the parcel service provider. To do this, simply click on the DHL shipping options in the checkout process. (More under shipping conditions)

4. Payments

Payments are made immediately by American-Express, Apple-Pay, Google-Pay, Master-Card, Maestro-Card, PayPal, Sofort-Überweisung or by Visa card at checkout. You will receive the invoice with the shipment.

5. Default in Payment

Orders must be transferred to our account within the specified payment term after receipt of the invoice. Only after receipt of money, both bank transfer and direct debit, will the goods be dispatched by us. If the invoice amounts are not paid by the due date, we reserve the right to charge an interest rate of 5 % above the respective Bundesbank discount rate, without the need for a default! Payments are always offset against the oldest debt! Should direct debits decrease due to insufficient funds in the account, we allow ourselves to charge a fee of £ 15.00 and also charge the above-mentioned default interest.

6. Warranty / return

Since PPS is not a manufacturer of the goods delivered, only the manufacturer's guarantee conditions apply. In guarantee cases, PPS must be informed before the product is sent in. The goods are to be checked for completeness immediately upon receipt and, if necessary, to be complained about directly to the deliverer. If the goods are defective or damaged, we must be notified immediately! If the error cannot be corrected by forwarding any replacement items, the goods will be returned to us postage paid! Here we deliver a replacement item or issue a credit!

6.1 If a complaint is not made within 5 days of receipt of the delivery, the acceptance is deemed to have taken place.

7. Liability / Warranty

Claims for damages against us due to the impossibility of performance, default due to negligence in the conclusion of the contract and from tort are excluded, unless they are based on intent or gross negligence on our part!

8. Retention of title

The delivered goods remain our property until they have been paid for in full!

9. Choice of law

9.1 German law applies to the legal relationships between PPS and customers as well as to the respective terms and conditions. The application of the UN Convention on Contracts for the International Sale of Goods of April 11, 1988, is excluded.

9.2 The provisions of Section 9.1 do not affect the mandatory provisions of the law of the country in which the customer has his habitual residence if and to the extent that the customer has concluded a purchase contract that cannot be used for the customer's professional or commercial activity (consumer contract) and if the customer has carried out the legal acts necessary to conclude the purchase contract in the state of his habitual residence.

10. Legal Effectiveness

Should individual provisions of this contract not be legally effective in whole or in part or lose their legal effectiveness at a later date, this shall not affect the validity of the rest of the contract. In this case, the parties undertake to replace the ineffective regulation with an effective regulation that, as far as legally possible, comes closest to the economic purpose pursued by the ineffective regulation, taking into account the interests of the parties expressed in this contract. The same applies if the contract shows a loophole not foreseen by the parties

11. Data protection

Your address is stored in our IT system for quick and error-free processing. The data provided is treated in accordance with the provisions of the Federal Data Protection Act. The PPS will not use, pass on or sell customer data beyond the scope regulated here.

11.1 Cookies are used on our website to retain the content of the shopping cart when switching back and forth or to recognize you when you visit our website again. Data security is guaranteed by general SSL encryption in the entire shop area.

12. European online dispute resolution platform

This so-called ODR regulation (Online Dispute Resolution) aims to create an independent, impartial, transparent, effective, fast and fair out-of-court option for the settlement of disputes. 13. The place of jurisdiction and performance for all disputes about the contract is Bayreuth!
